The Provincial Court of Madrid issues a key ruling
In an unexpected turn in the judicial arena, the Provincial Court of Madrid has acquitted a businessman accused of embezzlement and disloyal administration. This verdict brings an end to a lengthy legal battle that began after his divorce, where his ex-wife accused him of diverting over one million euros from their joint assets during the separation process.
The couple was married under the regime of community property from 2001 to 2019, and the dispute centred on the management of two family companies dedicated to technological innovation. The businessman, who was the sole administrator, faced serious accusations from his ex-wife, who claimed he had used the marital crisis to divert funds for personal purposes.
The businessman’s defence, led by criminal lawyer Juan Gonzalo Ospina, presented a strategy focused on demonstrating that the questioned financial movements were part of the normal operation of the businesses. During the trial, several witnesses confirmed that the transfers made to Bulgaria were related to actual work on international projects.
A crucial expert report presented by the defence concluded that the analysed payments were consistent with ordinary activities and the development of new business projects. The final ruling emphasises that it was not proven that the accused acted with malicious intent or to harm the community property or enrich himself personally.
This ruling not only acquits the businessman but also reinforces the principle of minimal intervention of Criminal Law. The judges emphasised that such property disputes arising from marital processes should be resolved in civil rather than criminal courts. Thus, an important precedent is established on how to address similar disputes in the future.
As this case closes a complicated chapter for both parties involved, it is clear that judicial decisions can have significant repercussions beyond the personal sphere, also affecting the legal framework on how property conflicts are managed after a divorce.
