A case that challenges the interpretation of self-defence
In an unexpected turn of events, a homeowner in the Community of Madrid finds himself at the centre of a legal controversy after shooting an assailant during a violent assault on his home. The incident occurred on 11 July 2023, when the man, identified as C. A. R., was surprised by two armed criminals who broke into his residence.
According to judicial reports, the main assailant, H. M. M. S., and his accomplice, S. U. R. B., managed to enter the home after forcing the entry while threatening the homeowner with a gun. Amid the chaos, C. A. R., determined to protect his life and home, managed to disarm H. M., using the weapon to fire several times at his attackers.
Despite having acted in what many would consider an extreme situation of self-defence, C. A. R. now faces a possible sentence of up to seven years in prison for the shots fired during the altercation. The prosecution argues that the homeowner's response was disproportionate for firing five times at H. M., who was severely injured and is currently confined to a wheelchair.
Additionally, a compensation claim of over 500,000 euros has been requested by the assailant against C. A., alleging injuries and moral damages resulting from the incident.
Under the Spanish legal framework, self-defence is not as straightforward as it may seem; there is no absolute right to defend private property with lethal force without significant legal consequences. Article 20 of the Penal Code establishes strict criteria on when self-defence can be claimed and whether it is considered proportional or excessive.
In this particular case, judges will have to decide whether C.A.R acted within the limits permitted by law or if he exceeded his right to defend himself against an imminent threat to his life.
This case has reignited discussions about the urgent need to reform laws related to self-defence in Spain, where many citizens feel unprotected in similar situations and fear legal repercussions after acting to protect themselves or their property.
As this landmark trial progresses, it is clear that the decisions made by C.A.R will not only affect his immediate future but could also set important precedents on how defensive actions are interpreted within the Spanish legal context.
