The Supreme Court upholds the expulsion of a civil guard convicted of gender violence

A case that shakes the Civil Guard

In a ruling that resonates in the realm of public safety, the Supreme Court has confirmed the expulsion of a civil guard after being sentenced to three years and nine months in prison for assaulting his ex-wife. This case, which dates back to March 2, 2020, highlights the serious implications that can arise when a member of law enforcement is involved in acts of violence.

The chilling incident occurred when the victim was in a vehicle with another man. Suddenly, the civil guard appeared and, after opening the passenger door, pointed his weapon at the companion, demanding that he leave the car. In a terrifying sequence, he dragged the man to his knees and aimed the gun at him while making lethal threats.

The aggressor's ex-wife did not hesitate to intervene; upon exiting the car, she asked if he also intended to kill her. In response to her bravery, the civil guard directed his weapon at her and began kicking her while continuing to aim the revolver at her. The situation culminated when he decided to pursue the man he had previously threatened.

Following the violent incidents, the Criminal Court number 1 of Ávila issued a ruling in March 2023. The court found the civil guard guilty not only of serious threats but also of injuries within the family context. The Provincial Court confirmed this decision and the Supreme Court ultimately rejected the appeal filed by the convicted individual.

As a result of this criminal conviction, in July 2025, an administrative sanction was imposed that led to his separation from service as a civil guard. This measure was adopted by the Ministry of Defence after assessing the seriousness of the crime committed and its negative impact on the institutional image.

The Supreme Court emphasized that crimes related to domestic violence have significant repercussions not only for the direct victims but also for the public perception of the institutions responsible for ensuring citizen security. According to their words: "It is essential that those who are part of the police force have not been convicted of violent or threatening conduct."

This case opens a crucial debate on how to handle similar situations within the police force and how to ensure that those tasked with protecting citizens always act in accordance with the expected ethical and legal values.
