A new approach to public administration
The Community of Madrid is about to implement a significant change in its regulatory framework with the creation of a decree aimed at eliminating obsolete laws and simplifying administrative procedures. This ambitious project, expected to be approved in the second half of 2026, aims to modernise public administration and make it more efficient.
One of the most notable features of the new decree is the requirement to evaluate all regional laws every four years. This will allow for the identification of provisions that no longer serve their purpose or require adjustments. The affected regulations include rules on the internal functioning of the Administration, as well as provisions related to collegiate bodies and the regime of the Social Dialogue Table.
The process also includes a public consultation procedure, where both citizens and businesses can express their opinions on current regulations. This initiative aims to encourage greater citizen participation in administrative decision-making and ensure that laws effectively respond to the needs of the public.
Through the Interdepartmental Commission for the Reduction of Administrative Burdens and Regulatory Simplification, specific criteria will be established to carry out these reviews. Within a maximum period of one year from the entry into force of the decree, a proposal will be presented that prioritises positive administrative silence, meaning that if there is no express response within the stipulated time, it will be considered favourable for the applicant.
Organisational regulatory provisions will lose validity after five years, unless justified by their utility through positive evaluations. Additionally, a streamlined procedure will be implemented for simple laws that have passed all necessary checks, which promises to significantly reduce current timelines within the administrative system.
President Isabel Díaz Ayuso has emphasised that this measure is a fundamental part of the regional Government's commitment to moving towards a more citizen-oriented Administration. With this decree, Madrid seeks not only to eliminate unnecessary bureaucratic burdens but also to provide greater legal certainty to both citizens and investors. The initiative is an integral part of the electoral programme presented in 2023 and reflects a clear intention on the part of the regional Executive to adapt to modern times.
