A resounding ruling that sets a precedent

The Superior Court of Justice of Madrid has issued a historic ruling by upholding the sentence of revisable permanent prison for Micael da Silva, known as 'El Portugués', following the devastating crash that claimed the lives of four people during a wedding in Torrejón de Ardoz. This tragic incident occurred in the early hours of November 6, 2022, when the accused deliberately drove into guests outside the restaurant 'El Rancho'. Among the fatalities was a young man of just 16 years old.

The sentence, delivered on February 24, dismissed the appeals made by the prosecution and other parties involved, thus confirming the previous ruling of the Provincial Court. The judges concluded that there was sufficient evidence to demonstrate that 'El Portugués' acted with murderous intent by accelerating his vehicle towards a group of people, resulting in four completed murders and several additional attempts.

The defence argued that their client had acted under a state of insurmountable fear, claiming that he and his family had been threatened by other guests. However, the court found no sufficient evidence to support this version and upheld its decision based on testimonies and police reports.

Despite the verdict being favourable to the victims, lawyer Jaime Sanz de Bremond, legal representative of some affected families, expressed concern over the lack of compensation. He criticized the Insurance Compensation Consortium for not having advanced any amount to the relatives or the injured. According to Sanz, any further attempts by the Consortium to appeal to the Supreme Court would only unjustly prolong the economic and emotional suffering already endured by these families.

During the trial, heartbreaking statements were heard about how that fateful day changed lives forever. The prosecution strongly supported the penalties requested by the private accusations due to the severity of the crime. The jury considered that there was no room for mitigating circumstances given the brutal nature of the case.

This case has sparked intense debate about public safety at social events and how seemingly festive situations can turn tragic in a matter of seconds. The judicial decision not only seeks to deliver justice to the victims but also to send a clear message about the severe consequences faced by those who act with violence and recklessness.
